Female Wrestlers Score Another Victory in Federal Court
Former UC Davis wrestlers Arezou Mansourian, Chris Ng, and Lauren Mancuso celebrated another victory in their case challenging the failure of UCD to provide women equal athletic opportunities.
On December 8, 2010, a Sacramento federal judge denied motions by four top university officials who claimed that there were entitled to qualified immunity from suit because their acts purportedly did not violate constitutional rights. ERA Managing Attorney Noreen Farrell applauded the decision, which affirms that that the Equal Protection Clause of the Fourteenth Amendment of the U.S. Constitution prohibits sex discrimination and clearly did so at the time of the alleged discriminatory conduct in this case.
Noting evidence submitted by Plaintiffs that the individual defendants were aware of the athletic department’s gender equity failings and their callous indifference to it, the Court has ruled that a jury must decide whether these individual defendants violated the constitutional rights of the women wrestlers. Trial against the Regents of the University of California and the individual defendants, including the former chancellor and current athletic director, is scheduled for April 2011.
ERA’s co-counsel on the case include The Sturdevant Law Firm, Duckworth Peters Lebowitz Olivier LLP, and Equity Legal.
