ERA and Partners Urge EEOC to Preserve 60 Years of EEO-1 Employer Demographic Data

Yesterday Equal Rights Advocates, the National Partnership for Women and Families, the National Women’s Law Center, and more than 25 partner organizations submitted an official comment to the Equal Employment Opportunity Commission (EEOC) opposing its proposal to end a 60-year practice of collecting workplace demographic data from large employers.
Such reports, known as EEO-1, have been used by every administration for the past six decades to help the EEOC perform its stated purpose of combating large-scale employer discrimination and increasing workplace equality.
ERA’s co-authored comment, submitted August 24, 2026, as part of the public comment period, posits the EEOC’s proposed rule “undermines efforts to combat workplace discrimination, fails to comply with statutory requirements… relies on unsupported and inaccurate legal justifications, and omits a full analysis of the Proposed Rule’s costs and regulatory alternatives.”
“EEO-1 data has been vital to the efficient and effective enforcement of civil rights laws at the federal and state level and in private enforcement. The Proposed Rule fails to consider these important factors,” the comment states.
More than 700 individuals also submitted comments to the EEOC opposing the rule through ERA’s grassroots action campaign.
