SF Chronicle: Silicon Valley likes to use NDAs. A California bill could let more employees speak out

The San Francisco Chronicle ran an article about SB 331 (introduced by Senator Leyva and co-sponsored by ERA and CELA), which expands prohibitions on NDAs to apply to all forms of discrimination and harassment.

ERA Senior Counsel for Workplace Justice & Public Policy Jessica Stender was featured in the article.

There are exceptions to the protections in the bill, said Stender with Equal Rights Advocates.

She said like SB820, the protections in the new bill only apply once a worker has brought a lawsuit or made a formal complaint to state or federal authorities. That would allow workers who wish to protect their identity or keep the settlement amount confidential to do so.

“The purpose is to not silence workers from talking about what happened to them,” Stender said.
